II. Data protection information on the processing of your data in connection with the application

We collect and process your personal data in order to carry out the selection process. The data you provide will be processed for the purpose of processing your application and, if an employment relationship is established, also for the purpose of implementing the employment relationship.

Individual data

In connection with the creation of an account with the online tool: E-mail address, surname, first name, password, the country in which you wish to apply, whether you wish to receive notifications of new vacancies.

If you are not an EU citizen: Details of your citizenship, details of your residence permit (residence and work permit)

If relevant to the advertised position and legally permissible: information on health suitability, information on the existence of a severe disability, information on previous convictions; data from the police clearance certificate; data from the driving license

Data Processing
The provision of your personal data is not required by law or contract, but is necessary for the application process with us. Neither fully automated decision-making nor profiling is used to process the data you provide.

Further possible sources
Personnel service providers, recruitment agencies, the references you provide us with, websites and other publicly accessible data on the Internet. This includes, for example, data that you transmit to us as part of an online profile on a job-oriented social network or that you have made public.

Special categories of personal data
Information on ethnic origin, political opinions, philosophical beliefs, trade union membership, biometric data, health data (Art. 9 GDPR) are only collected by us if this is required by law. If you provide us with unsolicited special categories of personal data, we consider this to be your express consent to the processing of this data.

Inclusion in our talent pool
You have the option of having your personal data stored in our talent pool in order to be considered for interesting vacancies in the future. During this period, we may contact you and continue the application process if you are considered for a position.

Notification of further posts
On the online tool page, you can choose to receive notifications based on keywords or for specific job postings. You can also specify the frequency of the notifications via a drop-down field. In your profile, you have the option of displaying an overview of which notifications you have selected. You can also change or delete them here.


B. Consideration of your application within the group of companies

If your application is to be considered for other vacancies in the company or in the group of companies, we require a separate declaration of consent from you. We will contact you by e-mail for this purpose.


C. Establishment of an employment relationship

If there is an employment relationship between you and us, we may process the personal data already received from you for the purposes of the employment relationship in accordance with Art. 6 para. 1 sentence 1 lit. b GDPR.


D. Purpose and Legal basis for the processing of personal data

(Pre-)contractual measure
The application procedure is a necessary, pre-contractual measure for the possible establishment of an employment relationship. The processing of your data in the application procedure is based on Art. 6 para. 1 sentence 1 lit. b GDPR.

Consent
If you give us your consent to send you notifications about job advertisements, to include your data in the talent pool or to give us permission to pass on your data to affiliated companies, the legal basis for the processing of the data is Art. 6 para. 1 sentence 1 lit. a GDPR .
If you send us an unsolicited photo (from which special categories of personal data are derived) or other special categories of personal data, we consider this to be your express consent to the processing of this data in accordance with Art. 9 para. 2 lit. a GDPR.

Legal requirement
If required by law, we process your data to the extent necessary.

Legitimate interest
We use the SuccessFactors online tool to ensure that our application process is standardized and centralized. In order to offer you positions tailored to your qualifications, it is necessary to create and manage your applicant profile.

In connection with the use of the online tool, information about your login, the upload of documents, the saving of your draft application, your application and, if applicable, the completion of an application will also be processed in order to be able to track your requests accordingly in the system.

The processing is carried out, for example, for technical evaluation and analysis purposes in order to ensure the security of our information technology systems.

We store your data temporarily for the assertion, exercise or defense of legal claims (e.g. compliance with our duty of proof in proceedings under the General Equal Treatment Act (AGG)).

The legal basis for this is Art. 6 para. 1 sentence 1 lit. f GDPR.


E. Data erasure and storage duration

In case of refusal:
Your application documents will be anonymized or deleted six months after completion of the application process, unless you have given us your consent for longer storage (talent pool). We only store your personal data beyond this if this is required by law or in the specific case for the assertion, exercise or defense of legal claims.

After consent:
Storage of your data in our applicant/talent pool or for forwarding to affiliated companies in accordance with your declaration of consent. You have the right to withdraw your declaration of consent under data protection law at any time. The withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.

Own initiative:
You can delete your data yourself in the online tool. To do this, select the "Edit" option within your applicant profile. There you can delete your entire profile via "Options -> Settings -> Delete profile -> Delete all files". This deletion process will also delete your application. If there are still completed applications in our system, these can still be processed/stored in our system until the regular deletion date.

In case of employment:
We will transfer your application documents to your personnel file.


F. Recipient of the data

Company within our group of companies:
FFT Produktionssysteme GmbH & Co KG operates the applicant management tool. If you apply to an affiliated company of our group of companies, it acts as a processor for the respective responsible companies. A corresponding data protection agreement has been concluded in writing for this purpose.

If you apply for an apprenticeship at FFT Produktionssysteme GmbH & Co KG, your data will also be processed by the service provider BBZ Mitte GmbH, Goerdeler Straße 139, 36100 Peterberg. A corresponding data protection agreement has been concluded in writing for this purpose.

Online applicant management tool:
As part of your application, either you yourself or, in the case of e-mail applications, we will create a profile in our online applicant management tool SuccessFactors. Your data will be transmitted in encrypted form and stored in a database. This database is operated by SAP SE. In this context, SAP SE is the processor of FFT Produktionssysteme GmbH & Co KG in accordance with Art. 28 GDPR.

Within our organization:
Only the departments and divisions involved in the implementation of your application procedure and in the decision on your recruitment will have access to your personal data.

In the context of service provision:
Processors are commissioned to fulfill the above-mentioned purposes. These are, for example, service providers for IT maintenance services or video conferencing tools (so-called processors). These service providers only act on the instructions of the controller and are contractually obliged to comply with the applicable data protection requirements. To this end, we conclude corresponding order processing contracts with these service providers in writing.

Other third parties:
We may transfer personal data to courts, supervisory authorities or law firms if there is a legal obligation to do so pursuant to Art. 6 para. 1 sentence 1 lit. c GDPR or if it is necessary pursuant to Art. 6 para. 1 sentence 1 lit. f GDPR for the assertion, exercise or defense of legal claims and there is no reason to assume that our employees have an overriding interest worthy of protection in not disclosing the data.


G. Data transfer to third countries

Application documents will not be forwarded to locations abroad. The data you provide will not be transferred to a third country or an international organization. If, in individual cases, you would like us to transfer the data you have provided to a third country or an international organization, we will only do so with your written consent.


H. Rights of the data subject

If your personal data is processed, you are a data subject under the GDPR and have the following rights against the controller:

Right of access by the data subject, Art. 15 GDPR
Within the framework of the applicable legal provisions, you have the right to (free) information about your collected and stored personal data at any time. This also includes information about the purposes of processing, its origin and recipients, the storage period and the existence of various rights.

Right to rectification, Art. 16 GDPR
You have a right to rectification (also in the sense of completion) of your data if the processed personal data concerning you is incorrect or incomplete for the purpose of processing. The controller must make the correction without delay.
